1.1 “Essio Marketing Ltd / Essio / we / us / our” refer to Essio Marketing Ltd.
1.2 “the client / you / your / the website” refer to the client contracting with Essio to modify the client’s website, and the website to be modified.
1.3 “traffic” refers to the amount of unique visitors to the client’s website.
2.1 Essio Marketing Ltd, (hereafter referred to as ‘Essio’), guarantee that after the predetermined time priod that Essio have commenced work on the client’s website, (hereafter referred to as ‘the website’), that traffic to the website will have increased from the level of traffic recorded prior to Essio commencing any work. If this guarantee is not fulfilled, Essio are bound by this guarantee to refund any monies expended to Essio by the client, and remove any work / adjustments made to the website.
3.1 Prior to any work being undertaken by Essio, we will monitor the website’s traffic using analytical software. This software will record data such as the number of visitors, which page(s) each visitor viewed, etc. This software will not record personal details, and as such maintains aggregated figures. This monitoring will take place over 7 consecutive days, and the total traffic, (hereafter referred to as ‘initial traffic’), will be calculated.
3.2 Once Essio have implemented any changes to the website, the guarantee will commence. Essio will notify the client of the starting and expiry dates of the guarantee at the commencement of the guarantee, and will maintain a copy of these dates for legal purposes. On every seventh day within the total predetermined time priod, the website’s traffic for that week will be calculated. After the last week, there will be a remaining 4 days left of the guarantee. The total traffic for these four days will be added to the total traffic for the last three days of the preceding week to create the final whole week.
3.3 Total traffic figures for each week will be recorded in writing and kept for legal purposes, and a copy supplied to the client within reasonable time.
3.4 If, in any week during the predetermined time priod covered by the guarantee, the total traffic for the website is greater than the initial traffic, Essio will deem this guarantee as being fulfilled, and no monies may be reclaimed by the client regarding this guarantee.
3.5 Should the total traffic for all recorded weeks within the predetermined time priod fail to exceed the initial traffic level, Essio will be deemed not to have fulfilled this guarantee, and monies expended by the client for work completed by Essio will be reclaimable. It is the client’s responsibility to notify Essio of this circumstance, should it arise, and the client will have 14 working days to contact Essio with regard to the issue. Any claims made outside the 14 working days will not be redeemable. Once Essio has been notified that the guarantee has not been fulfilled, Essio will refund any monies paid by the client to Essio, after having removed any work / additions / enhancements, etc, made to the website by Essio.
3.6 Refunded monies will need to be paid in the same manner as they were given to Essio. That is, if the client initially paid via a credit / debit card, the refunded money will need to be paid into the same account.
